TERMS AND CONDITIONS OF SALE AND SERVICE

1. BUSINESS INFORMATION
These Terms and Conditions of Sale and Service apply to the services provided by:

Hereinafter referred to as "Firefly", "the Coach", "we", "us" or "our".
The purchaser or user of the services is hereinafter referred to as "the Client" or "you".
These Terms apply to services offered through firefly-zone.be, as well as services contracted directly with Firefly, unless specific terms have been expressly agreed upon in writing.
2. PURPOSE AND ACCEPTANCE OF THESE TERMS
These Terms define the rights and obligations applicable to the purchase, booking and use of services provided by Firefly.
By booking a session, purchasing a program, subscribing to a coaching service or purchasing any other service, the Client acknowledges having read and accepted these Terms.
Any specific conditions communicated when purchasing a particular offer supplement these Terms.
In the event of a conflict between these Terms and the specific conditions of an offer, the specific conditions applicable to that offer shall prevail.
3. SERVICES PROVIDED
Firefly provides services including:
Individual or group personal training, in person or online.
Personalized training programs and sessions.
Nutrition and habit coaching.
Habit and progress tracking.
Online coaching.
Other services may also be provided as described on the Website or communicated to the Client before purchase.
The exact content, duration and conditions of each coaching service are specified in the offer selected by the Client.
4. HEALTH AND FITNESS FOR PHYSICAL ACTIVITY
The Client is responsible for informing the Coach of any relevant information regarding their health, injuries, pain, physical limitations or medical conditions that could affect their participation in training sessions.
If the Client has any doubts regarding their ability to participate safely in physical activity, they are encouraged to consult an appropriate healthcare professional before beginning or continuing training.
The Client must immediately inform the Coach and stop exercising if they experience unusual pain, dizziness, discomfort or any other concerning symptoms.
Nutrition guidance provided as part of the coaching service is intended for educational and behavioural purposes.
It does not replace medical diagnosis, medical treatment or consultation with a doctor, dietitian or other qualified healthcare professional.
5. BOOKING SESSIONS
Sessions may be booked according to the available time slots communicated by Firefly, including through the Website, a booking calendar or directly with the Coach.
A booking is considered confirmed once the Client has received confirmation and, where applicable, the required payment has been received.
The Client agrees to arrive at the agreed location or connect to an online session at the scheduled time.
6. PRICES AND PAYMENT
The applicable prices are those communicated to the Client at the time of purchase or booking.
Unless otherwise stated, prices displayed to consumers include all applicable taxes.
Payment may be made using the payment methods available at the time of purchase.
Where payment is required before a service begins, Firefly reserves the right not to provide the service until payment has been received.
Where a payment plan or subscription is agreed upon, the Client remains responsible for respecting the payment schedule and commitment period communicated at the time of purchase.
7. SESSION CANCELLATION AND RESCHEDULING
A session may be cancelled or rescheduled by the Client at least 24 hours before the scheduled start time, subject to the Coach's availability.
Any session cancelled less than 24 hours before its scheduled start time, as well as any session missed without prior notice, may be considered completed and remain payable.
Where the session is part of a package, the session may consequently be deducted from the Client's remaining sessions.
Exceptions may be granted by Firefly in the event of exceptional and reasonably justified circumstances.
If the Coach cancels a session, the session will be rescheduled at a mutually agreed time.
If rescheduling is not possible, the affected session will be refunded.
8. PACKAGES, PROGRAMS AND SUBSCRIPTIONS
Where a service is sold as a package, program or subscription, its duration, number of sessions where applicable, price, payment arrangements and any minimum commitment period will be communicated to the Client before purchase.
Sessions and services included in a package must be used in accordance with the conditions applicable to the selected offer.
Specific conditions regarding the suspension, renewal or cancellation of a subscription are those communicated to the Client at the time of subscription.
9. RIGHT OF WITHDRAWAL FOR DISTANCE PURCHASES
Where a consumer enters into a distance contract, particularly through the Internet, they generally benefit from a 14-calendar-day withdrawal period starting from the date on which the service contract is concluded, unless an exception provided for by applicable law applies.
If the Client expressly requests that Firefly begin providing the service during this withdrawal period, Firefly may begin providing the service before the end of the 14-day period.
If the Client subsequently exercises their right of withdrawal before the service has been fully performed, the Client may be required to pay an amount corresponding to the portion of the service already provided, in accordance with applicable law.
Where the service has been fully performed before the end of the withdrawal period following the Client's express request and acknowledgement that their right of withdrawal will be lost once the service has been fully performed, the right of withdrawal ends.
Certain services relating to leisure activities provided on a specific date or during a specific period may also be excluded from the right of withdrawal where the legal conditions for such an exception are met.

10. COACHING RESULTS
Firefly undertakes to provide the agreed services professionally and to support the Client in working towards their objectives.
However, results depend on numerous individual factors, including the Client's consistency, training, nutrition, activity levels, sleep, health, lifestyle and adherence to the coaching process.
Therefore, unless a specific commercial guarantee has been expressly provided in writing, Firefly does not guarantee any particular result regarding weight loss, muscle gain, physical performance or body transformation.
Where a specific offer includes a commercial guarantee, including a money-back guarantee, its requirements, eligibility criteria and specific conditions will be communicated separately to the Client and shall form part of the agreement applicable to that offer.
11. CLIENT RESPONSIBILITIES
The Client agrees to provide accurate and relevant information allowing the Coach to appropriately adapt the coaching service.
The Client agrees to follow reasonable safety instructions, use equipment appropriately and behave respectfully towards the Coach, other participants and any facilities in which sessions take place.
Firefly may stop or refuse to continue a session where continuing the session presents an apparent safety risk or in the event of inappropriate behaviour.
12. FORCE MAJEURE AND CIRCUMSTANCES BEYOND OUR CONTROL
Firefly shall not be held responsible for delays or temporary inability to provide a service resulting from circumstances reasonably beyond its control.
Where possible, Firefly will offer a rescheduled session or an appropriate alternative solution when circumstances allow.
13. DIGITAL CONTENT AND USER ACCOUNTS
Certain services may provide access to digital content, training programs, videos, documents, applications or member areas.
Any login credentials provided to the Client are personal and must not be shared with third parties.
Firefly may suspend access to a member area in cases of misuse, violation of these Terms or non-payment, subject to applicable law.
14. INTELLECTUAL PROPERTY
Training programs, documents, videos, written content, methods, educational resources and other materials provided by Firefly remain protected by applicable intellectual property rights.
The Client is granted a personal right to use such materials solely in connection with their coaching service.
These materials may not be reproduced, resold, published, transmitted, distributed or otherwise made available to third parties without prior written authorization from Firefly.
15. LIABILITY
Participation in physical activity involves inherent risks.
The Coach aims to reduce these risks through appropriate programming, supervision and adaptation of exercises.
Firefly cannot be held responsible for damage resulting from relevant information being intentionally or negligently withheld by the Client, failure to follow safety instructions or use of a training program in a manner contrary to the instructions provided.
Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable Belgian law.
16. PERSONAL DATA PROTECTION
Personal data collected through the Website, bookings and coaching services is processed in accordance with the Privacy Policy available on firefly-zone.be.
Information regarding cookies and similar technologies is provided in the Website's Cookie Policy.
17. CHANGES TO THESE TERMS
Firefly may modify these Terms when necessary, including to reflect changes to its services, business practices or applicable legislation.
Updated Terms will apply to new contracts entered into after the updated Terms become effective.
Changes to these Terms will not retroactively reduce rights already acquired by a Client under an existing contract unless required by law or agreed upon by the parties.

This service assists with disputes between consumers and businesses established in Belgium.
Consumers should first attempt to resolve the issue directly with the business before referring the matter to the Consumer Mediation Service.
19. APPLICABLE LAW
These Terms are governed by Belgian law.
Any dispute shall be submitted to the competent courts in accordance with applicable legal rules, without prejudice to any mandatory rights available to consumers.
20. LANGUAGES
These Terms may be made available in several languages.
In the event of any discrepancy or difference in interpretation between the different language versions, the French version shall prevail, subject to any mandatory provisions of applicable law.
